How Did We Get a 96mph in a 70mph Case Dropped?

Our client contacted us in March 2025 after receiving a Notice of Intended Prosecution (NIP) for an alleged 96mph in a 70mph motorway limit.

Before taking the case forward, we first requested the relevant documentation and supporting enforcement evidence in order to properly assess the circumstances.

After reviewing the material provided, we offered to assist the client for a fixed fee of £320.00 for what was potentially a 6 penalty point offence.

We first requested the supporting evidence and relevant documentation

We first requested the supporting enforcement evidence from Staffordshire Police. After reviewing the material provided, we identified issues within the evidence and relied on the police’s own documentation when addressing the allegation.

Raising the concern and challenging the supporting evidence

After identifying issues within the evidence and reviewing documentation showing the device had been tested 4 months prior to the alleged offence, we challenged the matter further as we were not satisfied with the explanation provided.

Receiving a Single Justice Procedure Notice to plead guilty or not guilty

In April 2025, Staffordshire Police issued a Single Justice Procedure Notice (SJPN) after we refused the conditional offer of 6 penalty points. Given the seriousness of the issues identified within the evidence, we maintained our defence and entered a Not Guilty plea on behalf of our client.

Winning at the Magistrates Court hearing

After approximately 12 months and two court hearings, during which we supplied the court with our defence and supporting statements following the Not Guilty plea, the case was withdrawn due to insufficient evidence and inaccurate camera measurement.
